The Nevada Attorney General’s Bureau of Consumer Protection (BCP) asserts that rate modifications recently approved by the Nevada Public Utilities Commission (PUC), as part of a $119 million rate increase for NV Energy, conflict with state law. The BCP is among several intervening parties requesting that the PUC revisit its decision.

A hearing regarding these petitions for reconsideration has been scheduled for November 18.

The PUC authorized a peak demand charge permitting NV Energy to apply a higher kilowatt (kW) rate during the 15-minute interval of peak energy consumption each day. This adjustment impacts both residential and small commercial customers in Southern Nevada.

In its petition, the BCP highlights that Nevada law prohibits the PUC from endorsing any rate structure requiring residential customers to purchase electricity based on the time of day, day of the week, or season, unless the customer elects such a plan.

To demonstrate a possible statutory violation, the BCP references the commission’s order, which indicates the demand charge "varies based on the time during which the electricity is used."

Furthermore, the BCP contends that another statute precludes utilities from imposing fees or charges on solar generators—primarily rooftop solar customers—that differ from those assessed to other customers within the same rate class, had they not participated in net metering.
